Will the individual mandate be enforced for 2019?
The Affordable Care Act’s requirement that most people have health insurance remained in place for 2018.And, technically, the individual mandate (formally known as the individual shared responsibility provision) remains in effect now and in the future. The related tax penalty (i.e., the individual shared responsibility payment) remains in effect for 2018 as well.
What will change in 2019? The tax penalty will not be enforced. As of Jan. 1, 2019, the tax penalty will be repealed and you will not be penalized for failing to enroll in minimum essential coverage.
That means if you don’t have major medical insurance in 2019 and are not exempt, you won’t owe a tax penalty when you file your 2019 taxes in 2020. That said, if you go without any health insurance, you will be paying for healthcare out of pocket.
